PRIVACY POLICY

Di Donna Galleries, LLC, a Delaware limited liability company (“Di Donna Galleries,” "we," “us,” or "our") respects the privacy of visitors to our website, accessible at the domain: www.didonna.com (“Website” or “Site”), and to our galleries, events, and art fairs (collectively, the “Services”). This Privacy Policy is intended to inform you of our policies and practices regarding the collection, retention, use, and disclosure of any Personal Information through our Site and through our Services.

By submitting any information through our Site or in connection with our Services, you acknowledge and agree that we may process (i.e., collect, use, etc.) your Personal Information as described in this Privacy Policy.

 

THE INFORMATION THAT DI DONNA GALLERIES COLLECTS, AND HOW IT IS COLLECTED:

Di Donna Galleries collects Personal Information and Anonymous Information from you when you visit the Site, submit a request or support ticket, place an order, or in connection with our Services. "Personal Information" means information that can be used to identify a particular individual or Site user, including, for example, your name, address, telephone number, e-mail address, user name, and any information about you that is associated with or linked to any of the foregoing information, such as your IP address or geographic location information. • USER PROVIDED INFORMATION

You may voluntarily provide Personal Information such as your name, email address, postal address, phone number, and credit card information when placing orders, when requesting additional information about products, or participating in various activities on the Site or in connection with our Services. Di Donna Galleries may also collect your email address if you choose to sign up for email communications or newsletters from Di Donna Galleries.

• INFORMATION COLLECTED BY COOKIES 

In addition to the information that you choose to voluntarily provide, when you visit the Site, Di Donna Galleries sends cookies to your computer to collect information from you regarding your web-browsing activities, browser specifications, and device specifications.

HOW DI DONNA GALLERIES USES THE INFORMATION IT COLLECTS:

Di Donna Galleries uses your Personal Information to process and fulfill any orders you place and to complete any requests you make—including requests to receive email communications regarding products and newsletters. As part of processing and fulfilling your orders, Di Donna Galleries will use your Personal Information to process your payment, as authorized by you during the checkout process, and to communicate with you regarding the status of your order and delivery details.

Di Donna Galleries may use the information it collects from you to determine your purchase preferences, identify content that may be of specific interest to you, and deliver product offers or other content specific to your interests.

Di Donna Galleries respects your choice and will stop sending you promotional emails once you unsubscribe. Please note, however, that you may not opt out of non-promotional communications from Di Donna Galleries, including communications confirming successful order placements, communications sent for customer service purposes, notifications regarding important Site or policy changes, communications providing important security or data breach information, and communications containing other significant information related to your Personal Information for as long as it is retained by Di Donna Galleries.

Di Donna Galleries may create Anonymous Information records from Personal Information by excluding information (such as your name and/or IP address) that would allow someone to identify a specific individual. Di Donna Galleries may use this Anonymous Information to analyze request patterns and improve the Site and our performance of services offered through the Site. We will not perform any automated decision-making processes on the information that we collect.

While Di Donna Galleries will sometimes request your consent before using your Personal Information, there are many additional legitimate and lawful purposes for which Di Donna Galleries may collect and use your Personal Information without your consent. Di Donna Galleries will only retain the Personal Information we collect about you for as long as required for the purposes set out in this Privacy Policy or as required to comply with our legal obligations. Where we are permitted to engage in direct marketing, we may retain your Personal Information for that purpose and for as long as you do not unsubscribe from receiving such direct marketing from us. THE CONDITIONS UNDER WHICH DI DONNA GALLERIES WILL SHARE YOUR INFORMATION WITH OTHERS:

Di Donna Galleries may share Anonymous Information for any legitimate business purpose allowed under the applicable laws and regulations without notification or consent.

If Di Donna Galleries or its assets are acquired by another company, or Di Donna Galleries undergoes a re-organization that results in the creation of or transference of assets to a new entity, that company will possess your Personal Information and it will assume the rights and obligations regarding your Personal Information as described in this Privacy Policy.

Di Donna Galleries will not share your Personal Information with other, third-party companies for their commercial or marketing use without your consent or except as part of a specific program or feature for which you have the ability to opt-in or opt-out.

HOW YOUR INFORMATION IS SECURED:

Di Donna Galleries takes reasonable technical and organizational precautions, in addition to following industry best practices, to protect your information against loss, misuse, alteration, disclosure, unauthorized access, or destruction.

The Site makes use of Secure Sockets Layer (SSL) technology. Any Personal Information you provide through the Services is stored in Di Donna Galleries’ secure database in an encrypted format. Di Donna Galleries and its payment processing vendors adhere to the PCI-DSS standards as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express, and Discover, and implement additional generally accepted industry standards.

Di Donna Galleries has implemented industry-standard electronic means of protecting your Personal Information including storing your Personal Information behind a computer firewall, which is a barrier designed to prevent outsiders from accessing our servers. • In certain situations, you can object to the particular ways in which Di Donna Galleries is using your Personal Information; and 
• In certain situations, you can also request that Di Donna Galleries send your Personal Information to a third party.

Di Donna Galleries will take all reasonable steps to ensure that your Personal Information is handled according to your wishes.

Di Donna Galleries does not intentionally gather Personal Information about visitors who are under the age of 13, and you must be at least 13 years or older to use the Site. RIGHTS AND CHOICES FOR NEVADA CONSUMERS

If you are a resident of the State of Nevada, you have the right to request that Di Donna Galleries not sell the Personal Information we currently have about you or that we might collect about you in the future. Although it is currently Di Donna Galleries’  policy not to sell our consumers’ Personal Information, if you would like to register an email address with Di Donna Galleries to request that we not sell your Personal Information now or in the future, please send an e-mail with "Nevada Privacy Rights" in the subject line to privacy@didonna.com or contact Di Donna Galleries via the information provided in the “Contact Us” section, above.

Following our receipt of your request, we will make reasonable efforts to verify your identity and that the request is authentic. When we have verified your request, we will confirm that your Personal Information will not be sold by Di Donna Galleries. If you change your email address in the future, please note that you will need to re-register the new email address with us so we can continue to ensure that we do not sell your Personal Information.

Di Donna Galleries will only use the information you provide in connection with your request to process that request. The Personal Information you submit with your request will only be used to process your request, though Di Donna Galleries may store information relating to your request for up to 60 days in case you have additional inquiries. Any contact information provided in connection with a request to exercise your rights related to your Personal Information will not be used for direct marketing purposes and will not be shared with others unless necessary to verify your identity and complete your request.

Di Donna Galleries will do its best to respond to your request as soon as possible, and, in any event, no later than 30 days after receiving your request. Please note that making multiple requests at one time may delay the processing of your request. If additional time is required to complete your request, Di Donna Galleries will contact you within information regarding the delay.

In certain circumstances, some requests may need to be fulfilled in a logical order. For example, if you request to see what information Di Donna Galleries has about you and at the same time request that Di Donna Galleries erase your Personal Information, Di Donna Galleries will first provide you with access to your Personal Information, before asking you to confirm your request to delete that information.
